Can the spouse of a full-time student apply for an open work permit?


I am the spouse of a full-time student enrolled in a university in Canada. Can I apply for an open work permit?


Spouses or common law partners of certain foreign students are allowed to accept employment in the General Labour Market without an LMIA, hence apply for an open work permit. This exemption from LMIA is intended for spouses who are not, themselves full time students. Applicants must provide evidence that they are spouses or common law partners of study permit holder who is a full time student at a CANADIAN university, college, CEGEP, Publicly funded trade or technical school or private institution authorized by provincial statute to confer degrees.


To make a successful application, an Applicant must give strong evidence of genuineness of relationship. They should also give evidence of work history and education to prove employability and financials to show that they can support themselves prior to finding a job. They must also be able to establish strong family ties to their home country.
